Data Protection Declaration of itl Institut für technische Literatur AG (“itl”)

Data protection is a matter of trust and your trust is important to us. In this data protection declaration, we shall therefore inform you how and the purposes for which we collect, process and use your personal data.

This data protection declaration is based on the terms of both the Swiss Data Protection Act and the European General Data Protection Regulation – GDPR for short. Whether and to what extent the GDPR is applicable shall depend on each individual case.

1 Who is responsible for data processing?

In terms of data protection law, the company responsible for the specific data processing is the company that determines whether the processing should take place, the purposes for which it is carried out and how it is structured. This is us and our contact details:

2 What kind of personal data do we collect and process?

In addition to the information that you yourself provide to us (what you tell us and what you do for us), we may also obtain information about you from third party sources, namely:

  • Basic data about you or about your employer with whom we have dealings (e.g. salutation, name, contact details)
  • Contractual data, i.e. all personal data in connection with the conclusion and execution of the contract. This also includes information about the initiation and conclusion of contracts, about our interactions with you, about defects and complaints as well as amendments to a contract.
  • Data from individuals in your environment (employer, work colleagues, legal representatives, etc.), e.g. information you provide on contact persons, references (e.g. in connection with a job application and your professional duties) or powers of attorney
  • Recommendations/third-party information about you
  • Your social media/on-line activities
 

3 Does personal data get sent abroad?

We process and store personal data for the most part in Switzerland and the European Economic Area (EEA). In certain cases, however, we may disclose personal data to service providers or other recipients located outside this area or who process personal data outside this area, in principle in every country in the world. In the event that this is a country without an adequate level of data protection, EU standard contractual clauses shall apply in particular to any transfer of data. Please note that such contractual precautions partially compensate for weaker or inadequate legal protection, but cannot completely rule out all risks (e.g. government access abroad). In exceptional cases, a transfer of data to countries without an adequate level of protection may also be permissible in other cases, e.g. based on consent, in connection with legal proceedings abroad or if the transfer of data is necessary for the execution of a contract.

4 For what purposes do we process personal data?

The data is processed for the following purposes (in addition to those that we will inform you about separately):

  • Communication (in particular to respond to enquiries, to contact you in the event of questions, customer service and customer care)
  • Conclusion and execution of a contract (everything that is necessary or expedient to conclude, implement and, if necessary, enforce a contract)
  • Information and marketing (e.g. mailings, events, training, instructions and further training)
  • Security (namely to ensure IT security, to prevent theft, fraud and misuse and for evidence purposes)
  • Administration (in particular to operate the infrastructure and the website, management, accounting and risk management)
  • Safeguarding of rights (namely to assert claims in court or out of court, in dealings with authorities in Switzerland and abroad or to defend ourselves against claims)

5 To whom do we disclose personal data?

We may transfer personal data that we receive from you or from third-party sources to other companies in the itl group (itl Institut für technische Literatur GmbH with headquarters in Vienna, Austria, itl Institut für technische Literatur AG with headquarters in Munich, Germany, and itl Technische Literatur S.R.L. with headquarters in Brasov, Romania). In addition, we may also disclose your personal data to companies outside the group if we are using their services.


 These are namely services in the following areas:

  • Translation services
  • Consulting and training services
  • Editorial services
  • Advertising and marketing services, e.g. for sending messages and information
  • Business administration, e.g. accounting or asset management
  • Payment services
  • Debt collection services
  • IT services, e.g. services in the areas of data storage (hosting), cloud services, sending email newsletters, data analysis

In individual cases, we may disclose personal data to other third parties for their own purposes, e.g. if you have given us your consent or if we are legally obliged or entitled to disclose the data. In these cases, the recipient of the data shall be the responsible party within the meaning of data protection law.

Examples of such cases include:

  • the transfer of claims to other companies, e.g. debt collection agencies
  • the disclosure of personal data to courts and authorities in Switzerland and abroad, e.g. to law enforcement authorities in the event of suspected criminal acts
  • the processing of personal data in order to comply with a court order or an official order or to assert or defend against legal claims or if we deem it necessary for other legal reasons In each case, we can also disclose personal data to other parties involved in the process.

6 What are your rights in connection with the processing of your personal data?

You have the right to object to data processing, especially if we process your personal data on the basis of a legitimate interest and the other applicable requirements have been fulfilled. You can also object to data processing in connection with direct marketing (e.g. advertising e-mails) at any time. 

If the applicable requirements have been fulfilled and no legal exceptions apply, you also have the following rights:

  • the right to request information about your personal data stored by us
  • the right to have incorrect or incomplete personal data corrected
  • the right to request that your personal data be deleted or rendered anonymous
  • the right to request that the processing of your personal data be restricted
  • the right to obtain certain personal data in a structured, conventional and machine-readable format
  • the right to revoke consent for the future, insofar as processing is based on consent.

Please note that these rights may be limited or excluded in individual cases, for example if there are doubts about your identity or if this is deemed necessary to protect other people, to protect legitimate interests or to comply with legal obligations.
